This Agreement is made between:
    Zoiko Telecom Ltd ("The Provider") and

    1. Definitions

    In this Agreement:
    "The Customer" refers to the individual or entity who subscribes to the broadband services, including both residential and business customers.
    "The Services" refers to high-speed broadband services provided by The Provider as selected by The Customer.
    "Plan" refers to the broadband package selected by The Customer.
    "FTTP" refers to Fibre to the Premises, the method by which broadband services are delivered directly to the customer's premises.
    "SOGEA" refers to Single Order Generic Ethernet Access, which is a method of providing broadband services without the need for a traditional phone line.
    Method of Delivery
    The broadband services provided under this Agreement will be delivered using either FTTP or SOGEA, as specified by The Customer at the time of registration.

    2. Services Provided

    The Provider agrees to supply The Customer with broadband services as per the chosen package. These services include:
    • Unlimited data usage
    • High-speed fibre broadband
    • UK-based customer support
    • Flexible contract options (12, 18, or 24 months)
    The Provider makes every effort to deliver consistent service but cannot guarantee uninterrupted access due to factors beyond its control.

    3. Plan Selection and Charges

    The Customer will be billed monthly for services according to the chosen broadband plan.
    Additional charges may apply for:
    • Any optional add-ons or extra features requested by The Customer.
    Invoices will be issued monthly, and payments are due within 7 days of the invoice date.

    4. Contract Term

    The term of this contract is that which was selected by The Customer,(12, 18, or 24 months) starting from the Effective Date. At the end of the initial term, the contract does not automatically renew, and The Customer may enter a new contract if desired.

    5. Payment Terms

    The Customer agrees to pay all monthly charges in full by the due date, using the payment method provided during registration.
    In the event of non-payment, The Provider may suspend or terminate The Services until payment is made.
    A late payment fee of £7 may be applied if payment is not received by the due date.

    6. Early Termination and Cancellation

    The Customer may cancel the Agreement at any time by providing 30 days’ notice after the initial contract term.
    Early termination within the contract term will incur an early exit fee equivalent to the monthly charge for each remaining month in the contract term.
    The Provider reserves the right to terminate the Agreement immediately if The Customer breaches any material terms, including non-payment or misuse of the services.

    7. Service Speeds and Performance

    The Provider strives to deliver the maximum speed available for the selected package, although speeds may vary depending on network congestion, location, and other external factors. The Provider does not guarantee a minimum speed but will endeavor to maintain a reliable connection.
    The Customer acknowledges that speeds may be slower during peak usage hours.

    8. Installation Fees and Setup

    If an installation or setup fee applies, The Customer will be notified of the cost during registration. The Customer is responsible for providing access to the premises for any necessary installations and ensuring a suitable environment for the setup. Self-installation options may also be available, depending on the package selected.

    9. The Customer agrees to:

    • Provide access to the premises for installation, maintenance, or repair as needed.
    • Avoid tampering with or modifying any equipment provided by The Provider.
    • Use the services in compliance with applicable laws and not for unlawful or abusive activities.
    • Failure to comply with these responsibilities may result in service suspension or termination.

    10. Disconnection or Suspension for Unlawful Use

    The Provider reserves the right to suspend or disconnect The Customer's service if it is used for illegal activities, excessive abuse, or any activity that may compromise the integrity of the network. The Customer will be liable for any damages caused by such misuse.

    11. Service Interruptions

    The Provider aims to provide continuous service but may experience temporary interruptions due to maintenance, network issues, or factors beyond its control. The Provider will attempt to notify The Customer of planned maintenance that may impact service availability.

    12. Data Protection and Privacy

    The Provider is committed to protecting The Customer’s personal information in accordance with the UK’s General Data Protection Regulation (GDPR) and relevant data protection laws. Personal data collected during the term of this Agreement will be used solely for service provision, billing, and communication with The Customer.

    13. Amendments

    The Provider reserves the right to amend this Agreement, including charges and terms, by providing The Customer with 30 days’ prior notice. If The Customer does not agree to the changes, they may terminate the Agreement before the amendments take effect, without penalty.

    14. Governing Law

    This Agreement is governed by the laws of England and Wales. Any disputes arising in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
